Responsible for data processing is:
HACOY GmbH
Oberföhringer Straße 26c
81925 Munich
Germany
Email Address: hello@hacoy.com
Thank you for your interest in our online store. The protection of your privacy is very important to us. Below we are informing you about the handling of your data.
1. Access data and hosting
You can visit our website without providing any personal information. Each time you access a website, the web server only automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of the access, the amount of data transferred and the requesting provider (access data) and documents the access. This access data is evaluated solely for the purpose of ensuring trouble-free operation of the site and improving our services. This serves to protect our legitimate interests in the correct presentation of our offer, which outweigh our interests in the context of a balancing of interests in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO. All access data is deleted no later than seven days after the end of your visit to the site.
1.1 Hosting
The services for hosting and displaying the website are partly provided by our service providers as part of processing on our behalf. Unless otherwise explained in this privacy policy, all access data as well as all data collected in forms provided for this purpose on this website are processed on their servers. If you have any questions about our service providers and the basis of our cooperation with them, please use the contact option described in this privacy policy.
This website is hosted and delivered by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. The forms on this website send their data to our own server in Munich, which Cloudflare connects to the internet.
Our cooperation with Cloudflare is based on the standard data protection clauses of the European Commission.
1.2 Content delivery network
For the purpose of a shorter loading time, we use a so-called Content Delivery Network ("CDN") for some offers. With this service, content, e.g. large media files, are delivered via regionally distributed servers of external CDN service providers. Therefore, access data is processed on the servers of the service providers. Our service providers work for us within the framework of order processing. If you have any questions about our service providers and the basis of our cooperation with them, please use the contact option described in this privacy policy.
Our service providers are located in these countries: USA
There is no adequacy decision of the European Commission for these countries. Our cooperation with you is based on these safeguards: standard data protection clauses of the European Commission.
We send our newsletter and the confirmation mail for your sign up through Resend (Resend, Inc., USA). To learn which topics interest our readers, our newsletter records whether it was opened and which of its links were clicked, through a small image and links that pass through our own system. This is part of the newsletter you agreed to under Art. 6 para. 1 p. 1 lit. a DSGVO, and it ends when you unsubscribe.
5.4 HACOY Partners waiting list
If you join the waiting list for HACOY Partners, we store your email address, the way you would like to work with us, your language, the consent text you agreed to, the time, your IP address and the page you came from, in our own system in Munich. We use them only to write to you once HACOY Partners opens, on the basis of your consent under Art. 6 para. 1 p. 1 lit. a DSGVO. You can withdraw your consent at any time by writing to hello@hacoy.com, and we then delete your entry.
2. Data processing for contract processing, contacting and when opening a customer account
We collect personal data when you voluntarily provide it to us as part of your order or when contacting us (e.g. via contact form or e-mail). Mandatory fields are marked as such, because in these cases we need the data to process the contract, or to process your contact and you can not send the order or contact without their information. Which data is collected can be seen from the respective input forms. We use the data you provide to process the contract and handle your inquiries in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO.
Insofar as you have given your consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO by deciding to open a customer account, we will use your data for the purpose of opening a customer account. Further information on the processing of your data, in particular the transfer to our service providers for the purpose of order, payment and shipping processing, can be found in the following sections of this privacy policy. After complete processing of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law in accordance with Art. 6 para. 1 p. 1 lit. c DSGVO, unless you have expressly consented to further use of your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement. The deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described in this privacy policy or via a function provided for this purpose in the customer account.
2.1 Requests through the forms on our website
Our website has forms for a repair, a showroom visit or personal shopping, made to measure sizing, and for a withdrawal, a membership cancellation or a privacy request. When you send one, we receive what you enter, for example your name, your email address, the piece, your order number or Meet your piece code, your message and, if you add one, a photo. We use it only to handle your request: for a repair, a visit or made to measure sizing on the basis of Art. 6 para. 1 p. 1 lit. b DSGVO, and for a withdrawal, a cancellation or a privacy request to meet our legal obligations under Art. 6 para. 1 p. 1 lit. c DSGVO.
The forms send your request to our own system, which HACOY GmbH operates in Munich; on its way there it passes through the Cloudflare network described above. To keep the forms free of spam and automated abuse, we process your IP address to limit the number of requests per hour, in our legitimate interest in safe forms under Art. 6 para. 1 p. 1 lit. f DSGVO. We keep your request as long as we need it to handle it and as long as statutory retention periods require, and then delete it. Our contact form opens your own mail program, so that message goes from your mailbox to hello@hacoy.com.
3. Data processing for the purpose of shipment processing
For the purpose of fulfilling the contract in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO, we pass on your data to the shipping service provider commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods.
3.1 Transfer of data to shipping service providers for the purpose of shipping
If you have given us your express consent to do so during or after your order, we will pass on your e-mail address to the selected shipping service provider on the basis of this consent in accordance with Art. 6 (1) p. 1 lit. a DSGVO, so that the shipping service provider can contact you before delivery for the purpose of delivery notification or coordination.
The consent can be revoked at any time by sending a message to the contact option described in this privacy policy or directly to the shipping service provider at the contact address listed below. After revocation, we will delete your data provided for this purpose, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

9. HACOY Music (streaming and listening statistics)
As part of your HACOY account we offer HACOY Music, our own playlists that you can stream inside the HACOY world. The music is hosted by us; we do not embed Spotify or any other third-party player, and no listening data is shared with such services.
Anonymous by default. When you play a track we record the play so that we can show aggregate figures such as the total number of plays and the most-played pieces. By default these records are not linked to you: they are stored without your account identifier and cannot be traced back to you. This anonymous, aggregated processing serves our legitimate interest in understanding and improving what our community listens to in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO.
Personalised statistics only with your consent. If you switch on personalised statistics, we link your plays to your HACOY account so that we can show you your own listening history and favourites, and so that we understand what our members enjoy. The legal basis is your consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO. This setting is off until you actively turn it on.
Withdrawal and control. You can withdraw your consent at any time under "My Music", as easily as you gave it. When you withdraw, we also remove the personal link from your earlier plays, so that they revert to anonymous. Withdrawal does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal. You can view the listening data we hold about you at any time and delete all of your listening data (plays, followed playlists and your consent record) with a single action.
What we store, and for how long. A play record contains the track and playlist, a timestamp and, only with your consent, your account identifier. We do not store the audio you hear or any recording of you. A playlist you follow is stored with your account so that your library is there when you return. Raw listening events are deleted automatically after 400 days; aggregate figures that cannot be traced to a person may be kept longer.
Recipients. Listening data is processed on our own infrastructure and is not passed on to third parties. Only authorised HACOY staff can see statistics, and named, person-level statistics are visible to them only for members who have switched personalised statistics on.
10. Contact options and your rights
As a data subject, you have the following rights:
- pursuant to Art. 15 DSGVO, the right to request information about your personal data processed by us to the extent specified therein;
- pursuant to Art. 16 DSGVO, the right to request without undue delay the correction of inaccurate or completion of your personal data stored by us;

If you have any questions about the collection, processing or use of your personal data, for information, correction, restriction or deletion of data, as well as revocation of consent given or objection to a particular use of data, please contact us directly using the contact details in our imprint.
Right of objection
Insofar as we process personal data as explained above in order to safeguard our legitimate interests that prevail in the context of a balancing of interests, you may object to this processing with effect for the future. If the processing is carried out for direct marketing purposes, you can exercise this right at any time as described above. If the processing is carried out for other purposes, you will only have the right to object if there are grounds arising from your particular situation.
After exercising your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.

Returns and refunds
Withdrawal. You can withdraw from your order within 14 days of receiving it, without giving a reason. The quickest way is the withdrawal button, or write to us at hello@hacoy.com. All details and the model withdrawal form are in the withdrawal notice above.
Sending pieces back. Please send the pieces back to us within 14 days of telling us that you withdraw. We bear the cost of the return. You only pay for a loss in value if it comes from handling the pieces beyond what is needed to check their nature, characteristics and functioning. Trying a piece on as you would in a shop is fine.
Refunds. We refund all payments, including the cost of standard delivery, no later than 14 days after we receive your withdrawal, using the same payment method. We may hold the refund until the pieces are back with us or you have shown that you sent them.
Exceptions. Pieces made to your personal measurements are excluded from the right of withdrawal (Section 312g (2) no. 1 BGB).
Defects. If a piece is faulty or not what you ordered, your legal guarantee rights apply. Please write to us at hello@hacoy.com with your order number.
